This is a binding agreement between you (“you,” “the customer,” “the user”) and BLK Orchid®, an owner-artist operated creative business (“we,” “us,” “our”).

BLK Orchid provides access to creative works and services including, but not limited to:

Physical and functional artwork
Digital art, illustrations, and designs
QR-integrated and interactive art experiences
Literary works and story-based intellectual property
Installations, events, and experiential projects
Educational, collaborative, or commissioned services

Availability of offerings may change at any time without notice.

2. Intellectual Property & Ownership

All content on this website—including artwork, text, images, designs, stories, code, QR experiences, audio, video, branding, and concepts—is the exclusive intellectual property of BLK Orchid®, unless explicitly stated otherwise.

You may not:

Copy, reproduce, distribute, modify, or exploit any content
Remove signatures, watermarks, or attribution
Claim authorship or resell BLK Orchid work
Use content for AI training, NFTs, or commercial purposes without written permission

Purchase of artwork does not transfer copyright unless expressly stated in a written agreement.

3. Purchases, Commissions & Custom Work

Custom and commissioned works are final sale
Deposits are non-refundable once work has begun
Timelines provided are estimates, not guarantees
Creative direction remains at the discretion of BLK Orchid unless otherwise agreed in writing

Additional revisions, scope changes, or usage rights may require separate agreements and fees.

4. QR, Digital & Interactive Content

Certain works include QR codes or digital access.

You acknowledge that:

QR-linked content may evolve, change, or expire
Access is for personal use only
Content may not be redistributed or duplicated
Circumventing access systems is prohibited

BLK Orchid is not responsible for device compatibility or third-party platform interruptions.

5. Artist-Affiliated & Collaborative Work

BLK Orchid may collaborate with or feature affiliated artists.

Each artist retains ownership of their respective work unless otherwise stated
Affiliation does not imply employment, partnership, or agency
Collaboration terms are governed by separate written agreements

6. User Conduct

You agree not to:

Harass, threaten, or misuse communication channels
Submit false, defamatory, or abusive content
Attempt unauthorized access to systems or data
Use the platform for unlawful or unethical purposes

Violations may result in termination of access without notice.

7. Limitation of Liability

All services and content are provided “as is.”

To the fullest extent permitted by law:

BLK Orchid is not liable for indirect or consequential damages
Liability is limited to the amount paid for the product or service, if any
